YPSILANTI TWP., MI — Allegations of unlawful sales of marijuana products has prompted Ypsilanti Township to sue a tobacco store under police investigation.
Police detail the allegations in a report on a Nov. 13 seizure of marijuana, psychedelic mushrooms, sales receipts and ledgers from the Corner Buzz Smoke Shop, 1627-1631 Holmes Road in the township.
Police reports are included in an emergency complaint Ypsilanti Township filed Dec. 8 against the business, owner and building landlord in Washtenaw County court. The township is asking a judge to declare the smoke shop a public nuisance in violation of state law and the township’s zoning ordinance, thus padlocking the store for a year, according to the complaint.
No criminal charges have been filed. The Washtenaw County Sheriff’s Office confirmed an investigation is ongoing.
Mohammad Abdelnaser Mohammad, who is identified as the shop’s primary owner and operator in the township’s suit, said he had sold the business to a new owner.
“I have really no part in whatever was going on,” Mohammad said.
He declined to say when he sold the business or answer further questions.
The shop was closed as of Tuesday, Jan. 6. A peek through the window reveals products have been removed.
“The property in question was engaged in this case in the illegal sale, manufacture and distribution of marijuana. They had all the receipts, invoices, et cetera,” Doug Winters, an attorney for the township, said.
“They are not a licensed dispensary,” and unregulated products and sales “is also truly a public health issue, because you don’t know where it’s coming from,” he said.
A police report from the Washtenaw County Sheriff’s Office shows that on Nov. 8, a deputy was in the area of the shopping complex writing citations for vehicles parked in a fire lane. A 20-year-old parked in the fire lane came out of the smoke shop, according to the report.
The deputy informed the 20-year-old they were not allowed to enter into a smoke shop or buy tobacco vapes, as the legal age is 21.
After returning to the station, the deputy noticed products he confiscated from the 20-year-old were not tobacco products but marijuana.
On Nov. 13, police executed a search warrant at the smoke shop, which turned up marijuana, psychedelic mushrooms and other evidence.
According to the report, police found 15 bags of marijuana. There were 20 grocery bags of prepackaged marijuana, including some near the front register, more in a drawer and two marijuana honey products.
There was also a large bag of psychedelic mushrooms in a safe.
Police also found drug ledgers, invoices, digital scales and daily reports during the search.
“I was not aware of this” until receiving the suit, shopping center landlord Paul Namazi of Gold Land Realty, LLC, said.
Selling marijuana from the store would have been a violation of the terms of the lease agreement, Namazi said.
He said Mohammad contacted him in December about assigning the lease to a different business entity, Exotic Cloud 3, LLC. That lease was executed for the storefront Dec. 19, he said.
Exotic Cloud 3 is a newly formed limited liability corporation that filed its articles of organization with the state on Dec. 4, according to the Michigan Department of Licensing and Regulatory Affairs.
A court hearing in the lawsuit is scheduled for 9 a.m. Wednesday, Jan. 21, in Washtenaw County 22nd Circuit Court.
