TAMPA, Fla. — A bill filed in the Florida Senate would let certain medical marijuana patients grow their own cannabis at home.
People who have a medical marijuana card and are at least 21 years old would be allowed to grow up to six flowering cannabis plants at their homes, according to the bill sponsored by Sen. Carlos Guillermo Smith (D-Orlando).
Under the legislation, anyone who grows the plant at home would have to keep it secure so that unauthorized people can’t access it. 
The bill also says that patients who sell marijuana plants or any products grown themselves or grow more than six plants could face criminal penalties.
Anything grown at home would still be subject to the same rules and limits that already apply to medical marijuana in Florida.
If the law is passed, it would take effect on July 1. 
This isn’t the first piece of legislation that has proposed allowing people to grow their own pot. Sen. Joe Gruters, R-Sarasota, filed a bill in 2025 that would’ve allowed qualified patients to grow up to two plants at home with a certificate from the Department of Agriculture. 
Although the bill died in committee and didn’t pass. 
Broader legislation aimed at legalizing recreational marijuana has also been proposed but has failed. In 2024, Amendment 3, which would’ve legalized it, didn’t reach the required 60% of votes to pass. 
If the law had been passed, Floridians aged 21 would have been able to legally possess up to 3 ounces of marijuana and up to 5 grams of marijuana in concentrate form for recreational use.
