INDIANAPOLIS (WTHR) – Will Indiana legalize marijuana this year?
Two bills introduced into the state’s 2026 legislative session could make it happen.
They come after President Donald Trump signed an executive order last month to reclassify cannabis as a Schedule III drug under federal law.
While the concept of legalizing marijuana is not new to the Indiana Statehouse, many Hoosier lawmakers have previously cited the drug’s Schedule I classification under federal law as a reason for opposition.
The change in classification and federal law raises the question – Is it enough to sway them?
The two bills introduced into Indiana’s 2026 legislative session to legalize marijuana originate from the House of Representatives. They are House Bill 1191 and House Bill 1298.
While both bills share a subject matter, they differ in their approach.
Below is a breakdown of each bill:
Unlike Indiana’s neighboring states, neither bill mentions creating a government agency to regulate the cannabis industry.
Both bills have been referred to the state’s House Committee on Courts and Criminal Code. However, neither has had a hearing scheduled yet.
