Recreational pot use in Florida remains illegal at the state level, but medical marijuana consumption is permissible.
Still, some state rules govern where medical marijuana, which requires a medical marijuana card, can be used, according to Sgt. Dominick Mesiti, Port St. Lucie Police spokesperson.
For example, taking medical pot or having it administered on public transportation or in any public place is not permitted, except for low-THC cannabis that’s not in a smoking form.
THC is believed to be the primary psychoactive ingredient in pot.
The same prohibition applies to medical marijuana in a school bus, vehicle, aircraft or motorboat, again, excepting low-THC cannabis not in smoking form.
In general, medical marijuana also can’t be used in a person’s workplace, unless allowed by the employer, or on school grounds or jails or state prisons.
A proposed constitutional amendment that would have permitted recreational marijuana was defeated in 2024. Amendment 3 would have allowed 21-year-olds and over to possess up to 3 ounces of marijuana or 5 grams in concentrated form.
