Recreational marijuana is now legal in North Carolina
The Cannabis Control Board (CCB), which is the tribal government office of the Eastern Band of Cherokee Indians, stressed that cannabis remains illegal  in other parts of North Carolina, in accordance with federal and state law.
The Qualla Boundary is tribal land of North Carolina, and is a sovereign territory with its own laws and judicial system.
Of North Carolina and its neighboring states, only Virginia allows legal recreational use of marijuana statewide.
Tribal members had already voted in a referendum in September 2023 in favor of adult recreational consumption also on their reservation, and had asked the tribal council to draft legislation to regulate that market.
Based on the referendum, the council last month approved language that decriminalizes cannabis on the Qualla border, but also updates the tribe’s laws to reflect its use.
