medical marijuana can now be purchased legally on North Carolina tribal land. On April 20, the first dispensary enabled for this purpose was inaugurated.
The dispensary is located on the Qualla Boundary tribal land in western North Carolina. However, the sale and consumption of medical marijuana is legal only in this territory.
The Cannabis Control Board (CCB), which is the tribal government office of the Eastern Band of Cherokee Indians (EBCI), highlighted that cannabis remains illegal in other parts of North Carolina, according to federal and state legislation.
The Qualla Boundary is tribal land of North Carolina, and is a sovereign territory with its own laws and judicial system.

The dispensary, operated by Great Smoky Cannabis Co. in the lands of the Eastern Band of Indians Cherokee, known as Qualla Boundary, is located at 91 Bingo Loop Rd, Cherokee, NC, 28719.

To access a patient card you can live anywhere in the state and prove that you currently reside in North Carolina.
The wait time for applications to be reviewed and printed may vary, officials said. Likewise, they indicated that applications will not be considered complete until payment is received, which is non-refundable.

Currently there are 18 types of medical conditions that are considered for requesting a medical cannabis patient card  in North Carolina. The interested party may have one or more of them:
According to the CCB guideline, a prescription or recommendation from your doctor is not necessary.
Only, the CCB mentions, you will have to submit written documentation about one or more of the 18 health problems along with your application. In addition, they clarify that it is not necessary to present the complete medical history. All you need to do is show that you have been diagnosed with one or more of the 18 health problems announced above.
There is currently a bipartisan effort so that the sale and consumption of medical marijuana can be possible throughout the state and not just in tribal territory.
North Carolina Senate approved, in March 2023, a bipartisan bill that allows the use of medical marijuana by people who have a debilitating illness.
According to SB 3“North Carolina Compassionate Care Law”, regulated use of medical marijuana would be allowed in people suffering from diseases such as cancer, epilepsy, multiple sclerosis (ALS), post-traumatic stress disorder (PTSD) and some terminal illness.
The proposal also amends existing state laws to protect patients and their doctors from criminal and civil penalties.
The initiative passed to the House of Representatives where it passed the first reading and was sent to the Health Committee.
In the short legislative session that began this Wednesday, April 24, legislative leaders in favor of this measure will seek to have the project discussed and approved in that chamber.
